India's top court says it never approved modified voter Form 6

Chief Justice of India Surya Kant said on Monday that the Supreme Court has not approved any modified version of Form 6 used in voter-roll revisions, undercutting the Election Commission's claim.

Why it matters: The Special Intensive Revision of voter rolls is one of India's most politically charged processes, with the opposition alleging mass disenfranchisement ahead of state elections. A petition now seeks prosecution of the chief election commissioner.

Hearing a petition seeking prosecution of Chief Election Commissioner Gyanesh Kumar, the chief justice said: “Any modified Form 6 has not been approved by us. Let’s be clear.” The remark matters because the Election Commission said in a September 26 press note that the new Form 6 declaration had been upheld by the Supreme Court in its May 27, 2026 judgment on the Bihar revision. The court had no occasion to examine the new declaration in that judgment, since it was introduced afterward.

The new declaration requires new voters to state whether they or their parents were mapped in the previous revision, a statement the earlier form did not seek. Two election commissioners had objected to the change, saying it required the central government to amend the Registration of Electors Rules, 1960. On Monday the Commission separately rejected opposition leader Rahul Gandhi’s allegation that Kumar changed Form 6 illegally, saying its June 24, 2025 order for the Bihar revision was unanimous and upheld by the court.

The court issued notice on the petition, which also seeks a judge-led investigation into alleged voter deletions, and tagged it with a similar pending matter.
