Senate Democrats question Meta research credits for data centers

Seven Democratic senators led by Ron Wyden have written to Meta chief executive Mark Zuckerberg demanding justification for research tax credits that rose from 700 million dollars in 2023 to 4 billion dollars in 2025, after reports the company classed its AI data centers as experimental pilot models.

Why it matters: If the pilot model reading fails, a tax channel worth more than 6.6 billion dollars over three years closes for the largest AI builders, and Meta's own filings already flag the credits as an uncertain tax position.

The October 14 letter from the Senate Finance Committee’s Democratic members asks Meta to answer ten questions by the end of October, including whether its research credits relate to the data center buildout and whether it consulted EY or other accounting firms before filing. The senators argue the federal research credit is meant for experimental work with a high degree of technical uncertainty, not for scaling commercially available infrastructure, and say Meta’s 2025 claims alone were more than 10 percent of all research credits claimed in the United States that year. Meta has not publicly responded; Datacenter Dynamics said it had reached out to the company for comment.
