The Competition and Markets Authority issued its final determination on Monday in the appeal brought by Gwynt y Môr Offshore Wind Farm Limited, RWE Renewables UK Limited and RWE Renewables UK Swindon Limited, ordering that the appeal not be allowed and that the Gas and Electricity Markets Authority decision of May 1, 2026 be confirmed, with costs reserved. The appeal challenged GEMA’s rejection of CMP344, a proposal to amend the Connection and Use of System Code so that allowed revenue increases reflecting income adjusting events would be recovered under the Transmission Demand Residual Tariff only, and thus not passed on to generators. Ofgem, whose governing body is GEMA, had rejected the proposed modification.
CMA dismisses RWE appeal over transmission charging change
The Competition and Markets Authority on Monday dismissed an appeal by RWE companies and confirmed the Gas and Electricity Markets Authority decision of May 1, 2026 to reject modification CMP344 to the Connection and Use of System Code.
Why it matters: CMP344 would have required allowed revenue increases from income adjusting events to be recovered only through the transmission demand residual, and its rejection leaves the existing recovery between generators and consumers in place.
Data as of CMA case page and final determination, October 19, 2026, both read directly. The order at paragraph 9.1 states the appeal is not allowed and the GEMA decision is confirmed, with costs reserved. Single primary source, hence grade B. Developing item.
